Terms And Conditions


This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.JUST1BAZAAR.com website.

 

Use of the JUST 1 BAZAAR Services

 

Please read the following terms and conditions carefully before registering on, accessing, browsing, downloading or using the JUST 1 BAZAAR website located at JUST 1 BAZAAR.com having its registered office at Plot No 229, Sector 4, D.No. 10-97, Visalakshi Nagar, Visakhapatnam, Andhra Pradesh 530043 and/or any of its affiliates on any device and/or before availing any services offered by JUST 1 BAZAAR on the JUST 1 BAZAAR Platform which may include various services or other service that may be offered by JUST 1 BAZAAR on the JUST 1 BAZAAR Platform (hereinafter individually, and collectively, the JUST 1 BAZAAR Services). For the avoidance of doubt, it is clarified that these terms and conditions shall apply to all JUST 1 BAZAAR Services or its affiliates.

 

1. Deliveries and Undeliverables

 

Shipments cannot be delivered to PO boxes or postal codes. Shipments are delivered to the Receiver’s address given by Shipper but not necessarily to the named Receiver personally. Shipments to addresses with a central receiving area will be delivered to that area.

 

JUST 1 BAZAAR may notify Receiver of an upcoming delivery or a missed delivery. Receiver may be offered alternative delivery options such as delivery on another day, no signature required, redirection or collection at a JUST 1 BAZAAR Service Point. Shipper may exclude some delivery options on request.

 

If the Shipment is deemed to be unacceptable / it has been undervalued for customs purposes, or Receiver cannot be reasonably identified or located, or Receiver refuses delivery or to pay Customs Duties or other Shipment charges, JUST 1 BAZAAR shall use reasonable efforts to return the Shipment to Shipper at Shipper’s cost, failing which the Shipment may be released, disposed of or sold without incurring any liability whatsoever to Shipper or anyone else, with the proceeds applied against Customs Duties, Shipment charges and related administrative costs with the balance of the proceeds of a sale to be returned to Shipper. JUST 1 BAZAAR shall have the right to destroy any Shipment which any law prevents JUST 1 BAZAAR from returning to Shipper as well as any Shipment of Dangerous Goods.

 

2. Shipment Charges and Fees

 

JUST 1 BAZAAR’s Shipment charges are calculated according to the higher of actual or volumetric weight per piece and any piece may be re-weighed and re-measured by JUST 1 BAZAAR to confirm this calculation.

 

Shipper, or the Receiver when JUST 1 BAZAAR acts on Receiver’s behalf, shall pay or reimburse JUST 1 BAZAAR for all Shipment or other charges due, or Customs Duties owed for services provided by JUST 1 BAZAAR or incurred by JUST 1 BAZAAR on Shipper’s or Receiver’s behalf. Payment of Customs Duties may be requested prior to delivery.

 

If JUST 1 BAZAAR uses its credit with the Customs Authorities or advances any Customs Duties on behalf of a Receiver who does not have an account with JUST 1 BAZAAR, JUST 1 BAZAAR shall be entitled to assess a fee.

 

3. Customs Clearance

 

JUST 1 BAZAAR may perform any of the following activities on Shipper’s or Receiver’s behalf in order to provide its services: (1) complete any documents, amend product or service codes, and pay any duties, taxes or penalties required under applicable laws and regulations (“Customs Duties”), (2) act as Shipper’s forwarding agent for customs and export control purposes and as Receiver solely for the purpose of designating a customs broker to perform customs clearance and entry and (3) redirect the Shipment to Receiver’s customs broker or other address upon request by any person who JUST 1 BAZAAR believes in its reasonable opinion to be authorized.

 

4. General Returns Policy

 

The following general returns policy is applicable to all items sold on JUST 1 Bazaar.

 

A. In general, an item may be eligible for return within the applicable return window if it fulfils one or more of the following conditions:
• Was delivered in a physically damaged condition
• Has missing parts or accessories
• Is different from what was ordered
• Is no longer needed (not all items may be eligible)
• Products marked as “non-returnable” on the product detail page cannot be returned. View the full list of non-returnable items.

 

B. All items must be returned in their original condition, with price tags intact, user manual, warranty cards, original accessories and in the original
manufacturer’s box/packaging as delivered to you. Refer to instructions to return items against each category. We may reject the return pickup if the items
are not returned according to the policy mentioned against each category.

 

C. Only Fulfilled by JUST 1 BAZAAR items may be eligible for replacement. For more details, please refer About Free Replacements.

 

D. Some items may not be eligible for return if you “no longer need it” (including cases of buyer’s remorse such as incorrect model or colour of product ordered or incorrect product ordered).

 

5. Circumstances Beyond JUST 1 BAZAAR’s Control

 

JUST 1 BAZAAR is not liable for any loss or damage arising out of circumstances beyond JUST 1 BAZAAR’s control. These include but are not limited to electrical or magnetic damage to, or erasure of, electronic or photographic images, data or recordings; any defect or characteristic related to the nature of the Shipment, even if known to JUST 1 BAZAAR; any act or omission by a person not employed or contracted by JUST 1 BAZAAR – e.g. Shipper, Receiver, third party, customs or other government official; “Force Majeure” – e.g. earthquake, cyclone, storm, flood, fog, war, plane crash, embargo, riot, civil commotion, or industrial action.

 

6. Shipper’s Warranties and Indemnities

 

Shipper shall indemnify and hold JUST 1 BAZAAR harmless for any loss or damage arising out of Shipper’s failure to comply with the following warranties and representations:
• All information provided by Shipper or its representatives is complete and accurate;
• The Shipment was prepared in secure premises by reliable persons and was protected against unauthorized interference during preparation, storage and any transportation to JUST 1 BAZAAR;
• Shipper has complied with all applicable customs, import, export, data protection laws, sanctions, embargos and other laws and regulations; and
• Shipper has obtained all necessary consents in relation to personal data provided to JUST 1 BAZAAR including Receiver’s data as may be required for transport, customs clearance and delivery, such as e-mail address and mobile phone number.

 

7. Payments could fail due to the following reasons:

 

• You accidentally entered incorrect credit/debit card details like name on the card, card number, CVV, 3D secure PIN and expiry date. In case of an American Express card, your transaction could fail if your billing address zip code/postal code is incorrect.
• The card details you provided are no longer valid or need to be updated.
• Your bank is going through an outage.
• You accidentally closed/refreshed the page or pressed backspace while the transaction was being processed by your bank.
• The connection between JUST 1 BAZAAR and your Bank failed due to some technical issues and the transaction couldn’t be completed.
• Your card may be blocked for online transactions.
• You might be using a card that is not accepted on JUST 1 BAZAAR currently.

 

You could also receive a payment pending message due to the following reasons:

• Payment confirmation pending: If you paid for your order using net banking, we may be awaiting the payment confirmation from your bank. This can sometimes take few days. For immediate status, contact your bank.
• Problem in contacting your bank or credit card: Sometimes we may be unable to contact your bank or card issuer which can cause delay. If so, you will receive an e-mail from us.
• Incomplete payment: If your initial payment attempt was unsuccessful, your payment might stay in pending stage. In such cases, try to revise the payment when you receive an e-mail from us, so that we can process your order immediately.

 

Note: If your payment is still processing, you will see a “We haven’t received payment confirmation from your bank or credit card yet”. In such cases, do not attempt paying a second time unless you’re sure that your payment failed. If you accidentally pay twice, we’ll refund your extra payment within a few days.

 

8. Amendments

 

These Terms of Use are subject to modifications at any time. We reserve the right to modify or change these Terms of Use and other JUST 1 BAZAAR policies at any time by posting changes on the Platform, and you shall be liable to update yourself of such changes, if any, by accessing the changes on the Platform. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other JUST 1 BAZAAR policies and note the changes made on the Platform. Your continued usage of the services after any change is posted constitutes your acceptance of the amended Terms of Use and other JUST 1 BAZAAR policies. As long as you comply with these Terms of Use, JUST 1 BAZAAR grants you a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use the Platform. By accepting these Terms of Use, you also accept and agree to be bound by the other terms and conditions and JUST 1 BAZAAR policies (including but not limited to Cancellation & Refund Policy, Privacy Policy and Notice and Take Down Policy) as may be posted on the Platform from time to time

 

9. Other Terms and Conditions

 

Additional terms and conditions may apply for You to avail specific JUST 1 BAZAAR Services and to specific portions or features of the JUST 1 BAZAAR Platform, including contests, promotions or other similar features, all of which terms are made a part of these T&Cs by this reference. You agree to abide by such other terms and conditions, including where applicable representing that You are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these T&Cs and the terms posted for or applicable to a specific portion of the JUST 1 BAZAAR Platform or for any JUST 1 BAZAAR Service offered on or through the JUST 1 BAZAAR Platform, the latter terms shall control with respect to Your use of that portion of the JUST 1 BAZAAR Platform or the specific JUST 1 BAZAAR Service. JUST 1 BAZAAR may make changes to any JUST 1 BAZAAR Services offered on the JUST 1 BAZAAR Platform, or to the applicable terms for any such JUST 1 BAZAAR Services, at any time, without notice. The materials on the JUST 1 BAZAAR Platform with respect to the JUST 1 BAZAAR Services may be out of date, and JUST 1 BAZAAR makes no commitment to update the materials on the JUST 1 BAZAAR Platform with respect to such JUST 1 BAZAAR Services.
